Terms of Use

1. Acceptance of Terms

These Terms of Use (“Terms”) form a binding agreement between Enble (ABN 26 740 833 518) (“Enble,” “we,” “us”) and the person or entity accessing enble.com.au, related domains, and any software, APIs or documentation we provide (collectively, the “Platform”).
By browsing, creating an account, purchasing services or clicking “I Agree,” you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old and able to enter a legally binding contract. If you register on behalf of a company or other entity, you confirm you have authority to bind that entity.

3. Scope of Services

Enble provides AI-consulting workshops, custom solution design, training materials, and related digital content (“Services”). Specific deliverables, timelines and fees may be set out in a separate statement of work (“SOW”) or order form. If there is a conflict between these Terms and an SOW, the SOW prevails to the extent of inconsistency.

4. Account Registration & Security

• You must provide accurate, current information.
• Keep your login credentials secure; you are responsible for all activity under your account.
• Notify us immediately at security@enble.com.au if you suspect unauthorised use.

5. Fees & Payment

Fees, GST and payment terms are as stated on the Platform or in your SOW. Invoices are due within 14 days unless stated otherwise. Late payments may attract interest at 8 % p.a. (compounded monthly) plus any collection costs.

6. Intellectual Property

Platform IP. We (and our licensors) own all rights in the Platform, including code, design, trademarks and content. You get a limited, revocable, non-exclusive licence to use the Platform for lawful business purposes.

Deliverables. Upon full payment, Enble grants you a worldwide, royalty-free, non-transferable licence to use deliverables created specifically for you under an SOW for your internal business purposes. We retain the right to reuse generalised know-how and non-confidential insights.

7. User Content

If you upload or input data (“User Content”) you grant us a licence to use, copy, modify and process that content solely to provide the Services. You represent you have all rights necessary and that your User Content doesn’t infringe third-party rights.

8. Acceptable Use Policy

• No unlawful, defamatory or misleading activity.
• No reverse-engineering, scraping or circumvention of security.
• No interference with other users or network integrity.
• No use of the Platform or deliverables for high-risk scenarios where AI errors could cause harm without appropriate human review.

9. AI Disclaimer

AI outputs and recommendations are generated from patterns in data and are provided “as-is” for informational purposes only. They do not constitute financial, legal or professional advice. You must exercise independent judgment and verify results before acting.

10. Availability & Maintenance

We aim for 99 % uptime but do not guarantee uninterrupted availability. Planned maintenance or unforeseen outages may occur. We will use reasonable efforts to provide advance notice of significant downtime.

11. Suspension & Termination

We may suspend or terminate your access immediately if you breach these Terms, fail to pay fees, or pose security/operational risk. Either party may terminate an SOW for convenience with 30 days’ written notice (fees for work performed to date remain payable).

12. Limitation of Liability

To the maximum extent permitted by law, Enble is not liable for any indirect, special, incidental or consequential loss, or loss of profits, revenue, data or goodwill.

Enble’s total aggregate liability arising out of or related to the Platform, Services or these Terms (whether in contract, tort or otherwise) is capped at the greater of AUD 5 000 or the fees you paid us in the 12 months preceding the claim.

13. Indemnity

You agree to defend and indemnify Enble, its directors and affiliates from any claims, losses or expenses arising out of your breach of these Terms, misuse of the Platform, or infringement of third-party rights.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via the Platform or email. Continued use after the effective date constitutes acceptance of the revised Terms.
